Please read our Terms and Conditions carefully before using the site or placing an order through our online shop. If you use the site or proceed to place an order for an item of your choice, you are deemed to accept and agree to these Terms and Conditions.

І. SUBJECT

Art. 1. These General Terms and Conditions are intended to regulate and govern all relations between „Bulkana Cosmetics Ltd“, hereinafter referred to as „SUPPLIER“, on the one hand, and the persons using the website with Internet address https://bulcanna.eu and the e-shop, hereinafter referred to as „USERS“ on the other hand.

Art. 2. When you visit, browse, use or make a purchase on this website and the e-shop, and by clicking on any object, link or button located on the pages with the internet address https://bulcanna.eu, except for the link referring to these Terms and Conditions, you are deemed to agree, fully accept and agree to be bound by the Terms and Conditions described below. „Bulcana Cosmetics Ltd reserves the right to change these terms and conditions at any time and on any occasion and your continued use of the site after such change shall be deemed to be your agreement and acceptance of the changed terms and conditions. These Terms and Conditions comply fully with the laws of the Republic of Bulgaria and the European Union. The Terms and Conditions are published in a prominent place and are accessible to any user.

III. CONCEPTS AND DEFINITIONS

Art. 4. The following terms and definitions used in these Terms and Conditions have the following meanings:

  • „SELLER“ is the website https://bulcanna.eu, which is owned by Bulkana Cosmetics Ltd. and serves as a virtual platform for the sale of goods. The Seller is the person with whom Users enter into a contract for the distance sale of specific goods in the e-shop.
  • „USERS“ are persons of legal capacity who have agreed to these Terms and Conditions in connection with the order and purchase of goods offered in the online store.
  • „ELECTRONIC SHOP“ is the website https://bulcanna.eu, which serves as a virtual platform for offering goods for sale and for reaching an agreement between the SELLER and USERS for the order and purchase of a specific good (item).
  • „ORDER“ is the order made by the Users to the e-shop for the purchase of one or more specific goods (items). The Order shall be packed and sent by courier to the address previously indicated in the Order by the Users, once approved by email or telephone.
  • „CONTRACT FOR SALE“ means the contract for the purchase and sale of goods concluded remotely through this e-shop between the Seller and the Users.
  • „COURIER“ is a merchant who physically delivers the purchased goods to the address specified by the Consumer and operates under the requirements of the Postal Services Act.
  1. USER PRIVACY

Art. 5. The Seller shall process and take measures to protect Users' personal data in accordance with the requirements of the Personal Data Protection Act and Regulation (EU) 2016/679 (GDPR). Users agree that the Seller has the right to process their personal data in connection with their use of the services of the https://bulcanna.eu. In order to service and fulfill your orders, we need to accept the following data: personal name, gender, valid email address, contact phone number, date of birth, physical delivery address, invoice address.

Art. 6. The data that the Seller receives when ordering or browsing the pages will be used solely for the service of the Users - accepting and fulfilling orders, contacting the Users in case of problems related to the order and improving the service of the e-shop. The Seller guarantees that this data will not be provided in any form to third parties or used for purposes other than those described above, except as provided by law.

Art. 7. The user is responsible for the protection of his/her username and password, as well as for all actions that are performed by him/her or by a third party using the username and password. The User shall immediately notify the Provider of any case of unauthorized access through the use of his/her username and password, and whenever there is a risk of such use.

  1. INFORMATION ABOUT THE GOODS

Art. 8. The User undertakes to fill in the necessary details when placing each individual order.

Art. 9. For each item, the relevant final price, main product features and additional information to support informed purchasing choices are listed and displayed on the individual presentation page. All prices on this site are inclusive of VAT and do not include delivery charges. Delivery prices are quoted separately and represent the delivery price of the specific courier company with whom we have contracted for deliveries.

  1. ORDER OF GOODS

Art. 10. The User can place orders in the Online Shop by adding the desired Goods for purchase following the steps indicated. Then complete and submit the corresponding Order. Ordering Goods means an expressed consent to enter into a distance selling contract, which is governed by the Consumer Protection Act.

Art. 11. Any Goods added to the Cart can be purchased if available. Adding Goods to the Shopping Cart without the Order being completed does not result in the Order being registered and the Goods being automatically reserved.

Art. 12. In order to place an order the User must specify:

  1. a valid e-mail address
  2. correct delivery address and billing address
  3. contact details filled in correctly - two names, telephone number

Art. 13. If the order is successfully placed, the User receives a confirmation of the order by e-mail to the e-mail address provided by the User. The email confirmation shall specify the goods ordered, the order number, the date on which it was placed.

Art. 14. The Supplier has the right to refuse to execute (cancel) the order placed by the User, for which it shall notify the User. Cancellation of the order shall not entail any liability or subsequent obligation of either party to the other in relation thereto and accordingly neither party shall be entitled to claim compensation from the other for cancellation in the following cases:

  1. non-acceptance by the User's issuing bank of the online payment transaction;
  2. making a monetary transaction that does not result in funds being credited to the Seller's account for online payments;
  3. the data provided in the e-shop is incorrect or incomplete.

VII. DELIVERY AND RECEIPT OF PRODUCTS

Art. 15. By sending an order confirmation, the automated system of the e-shop notifies the User by email of the successfully accepted order. By doing so, the User agrees to pay the value of the products selected and the cost of shipping.

Art. 16. Once an order has been verified and processed by the consultants of the e-shop, the User receives an email that the processing of the order has been completed.

Art. 17. The delivery shall be made to the address of the User or to the office of a courier company.

Art. 18. If the User does not provide access and conditions for the delivery of the goods or goods at the specified address within the specified period, the Seller shall be released from the obligation to perform the requested delivery.

VIII. PRICES AND PAYMENT

Art. 19. The prices of the goods are in BGN including VAT. Prices are shown excluding delivery charges, which you learn before completing your order.

Art. 20. Payment for orders may be made by: cash payment to the courier upon delivery (cash on delivery) or by debit/credit card.

  1. RETURN OF GOODS AND WITHDRAWAL FROM THE CONTRACT

Art. 22. (1) The User shall have the right to withdraw from the distance contract, without giving any reason, without compensation or penalty, within 14 days from the date of acceptance of the goods by the User or by a third party other than the carrier and designated by the User.

 (2) In order to exercise his right of withdrawal, the User must notify the Supplier of his decision to withdraw from the contract by an unequivocal application (e.g. a letter sent by post or e-mail), indicating his name, address, telephone number and e-mail address, as well as details of the order. The user may use the standard cancellation form (Appendix 1), but this is optional.

(3) Exceptions to the right of withdrawal. Pursuant to Art. 57 (5) of the Consumer Protection Act, the right of withdrawal and return does NOT apply to sealed goods that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection. All cosmetic products offered in the Online Shop fall into this category if their protective packaging (foil, sticker, cap seal) has been broken by the Consumer. In these cases, the Supplier reserves the right to refuse the return of the goods and the refund.

(4) When the User exercises his right of withdrawal (for products with intact integrity), the Supplier shall refund all amounts received from the User without undue delay and no later than 14 days from the date on which the User was notified of the decision to withdraw from the contract. The Supplier shall be entitled to postpone the refund until the goods have been received back or until proof has been provided that the goods have been sent back, whichever is the earlier.

(5) The cost of returning the goods shall be borne by the User.

Art. 23. Complaints and questions If you have any questions, complaints or comments, please contact us directly on 052/335159 or email us to discuss them. The consumer has the right to claim for any non-conformity of the goods with what was agreed/ordered, where after delivery, upon initial inspection or during storage, installation, testing or operation, non-conformities with the contract of sale are found.

Х. CONDITIONS FOR COPYING INFORMATION

Art. 24. The website and the e-shop contain images, pictures, texts, documents, databases, programs and other information that are copyright and property of Bulkana Cosmetics Ltd. and are protected by the Copyright and Related Rights Act. Reproduction, distribution, modification, public display, etc. of part or all of the contents of the site that are subject to intellectual property is prohibited and will be prosecuted as provided by law, unless there is an express written consent of Bulkana Cosmetics Ltd. for the relevant type of use.

  1. PRODUCT INFORMATION

Art. 25. Product information on the website and in the e-shop should in no way be used for the diagnosis, treatment or prevention of disease or health problems. The products are not medicinal products.

XII. DISPUTES AND COMPLAINTS

Art. 26. In case of disputes concerning obligations arising from online sales contracts where no agreement has been reached, the Consumer may refer the dispute to the Alternative Dispute Resolution (ADR) bodies under the terms and conditions of Article 181a et seq. of the Consumer Disputes Act. Further information on alternative dispute resolution for consumer disputes is available on the website of the Commission for Consumer Protection at https://kzp.bg and the online dispute resolution platform ODR.
